Terms of Use
1. Acceptance of Terms
By downloading, installing, or using the Toma app ("App") or accessing the toma.app website ("Site"), you agree to these Terms of Use ("Terms"). If you do not agree with any part of these Terms, do not use the App or the Site.
These Terms constitute a legal agreement between you ("User") and Sower Ventures Ltda. ("Toma", "we", "us", or "our"), the company responsible for developing and operating Toma.
2. Description of the Service
Toma is a travel planning app that uses artificial intelligence to generate personalized itineraries. Through the App, Users can:
- Create AI-generated personalized travel itineraries based on destination, dates, travel style, and budget
- Edit, reorganize, and customize suggested activities, restaurants, and attractions
- Invite others to collaborate on editing an itinerary
- Store travel documents (PDFs, images, .pkpass files) locally on the device
- Explore destination maps and discover nearby places
- Access reviews and tips from the user community
Toma is available exclusively for iOS devices and can be downloaded from the Apple App Store. Access to certain features is subject to a paid subscription plan.
3. Account Creation
3.1 Eligibility
To create an account, you must be at least 18 years of age or have authorization from a legal guardian. By registering, you represent that the information provided is true, accurate, and up to date.
3.2 Login methods
Toma allows account creation and login through:
- Apple Account (Sign in with Apple)
- Email address and password
3.3 Account responsibility
You are solely responsible for maintaining the confidentiality of your access credentials. Any activity carried out using your account is your responsibility. In the event of unauthorized use, contact our team immediately at suporte@tomatravel.app.
4. Plans and Subscriptions
4.1 Available plans
Toma offers access to premium features through subscription. The available plans are:
- Annual Plan: subscription billed annually, with full access to all premium features
- Per-Trip Plan: a one-time payment that unlocks premium access for a specific trip
Updated pricing for each plan is available inside the App, on the subscription screen.
4.2 Billing
All charges are processed directly by Apple through the App Store and are subject to Apple's terms and conditions. Toma does not store credit card data or any payment information.
4.3 Automatic renewal
The Annual Plan renews automatically at the end of each period, unless cancellation is made at least 24 hours before the renewal date. The Per-Trip Plan does not renew automatically.
4.4 Cancellation
Cancellation must be done directly in the App Store settings, under "Manage Subscriptions". Cancellation stops automatic renewal, but premium access remains active until the end of the already-paid period.
4.5 Refund policy
Refunds are managed exclusively by Apple, in accordance with their refund policy. Toma does not issue refunds directly. To request a refund, visit reportaproblem.apple.com.
4.6 Restoring purchases
If you reinstall the app or switch devices, use the "Restore Purchases" function inside the App to recover access to your plan.
5. Acceptable Use
5.1 You agree NOT to:
- Use the App for illegal purposes or in ways that infringe third-party rights
- Attempt to access, copy, or modify the App's source code
- Reverse-engineer the App or any part of the service
- Use automated systems (bots, scrapers) to access the App or its APIs
- Post offensive, discriminatory, defamatory, or rights-infringing content
- Share your access credentials with third parties
- Use the App in a way that harms other users or the service's operation
5.2 User-generated content
When you add notes, photos, reviews, or any content within the App, you represent that you hold the necessary rights to that content and grant Toma a non-exclusive license to store and display it to you and the people with whom you share the trip.
6. Trip Collaboration
By inviting others to collaborate on an itinerary, you are granting them permission to view and, depending on the access level set, edit the itinerary. Toma is not responsible for changes made by collaborators invited by the User themselves.
Invitations are valid for 7 days from the date of sending. The member limit per trip is 10 people.
7. Intellectual Property
7.1 Toma's property
All content in the App and on the Site — including code, design, interface, text, icons, logos, AI-generated itineraries, and other materials — is the property of Toma or its licensors and is protected by intellectual property laws. Reproduction, distribution, or creation of derivative works without prior written authorization is prohibited.
7.2 User's property
Personal data entered by the User — such as destinations, preferences, notes, and travel documents — belongs to the User. Toma does not claim ownership over that content.
8. Disclaimers
8.1 Itinerary quality
Itineraries generated by Toma are based on artificial intelligence and data available at the time of generation. Toma does not guarantee that information about opening hours, prices, availability, or conditions of places is accurate or up to date. We recommend always confirming information directly with establishments before traveling.
8.2 Service availability
Toma does not guarantee that the App will be available without interruption or free of errors. We may temporarily suspend the service for maintenance, updates, or technical reasons, without prior notice.
8.3 Third-party services
Toma uses third-party services, such as Google Places, to provide information about locations. Toma is not responsible for the accuracy, availability, or changes to that information.
8.4 Limitation of liability
To the maximum extent permitted by law, Toma shall not be liable for indirect, incidental, special, or consequential damages arising from the use of or inability to use the App, even if we have been advised of the possibility of such damages.
9. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with or without notice. We may also update these Terms periodically. Material changes will be communicated via in-app notification or email. Continued use of the App after such notice constitutes acceptance of the updated Terms.
10. Account Termination
You may request deletion of your account at any time, directly through the App at Settings > Account > Delete account. Deletion permanently removes your personal data and itineraries from our servers, in accordance with the applicable legal retention period. Documents stored locally on the device are not affected and must be removed manually.
We reserve the right to suspend or terminate your account in the event of a violation of these Terms, with no right to a refund for any unused period.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the city of São Paulo, state of São Paulo, shall have exclusive jurisdiction to resolve any disputes arising from these Terms.
